THESIS STATEMENT: The Great and General Court of Massachusetts has erred in reforming the juvenile justice system by implementing policies and procedures that will harm juveniles and place society at risk.   Ã‚  Ã‚  Ã‚  Ã‚  On July 23, 1995, an intruder brutally attacked and stabbed Janet Downing approximately 100 times in her Somerville home. The revolting Downing murder and ensuing arrest of Edward O'Brien Jr., a 15-year-old juvenile whom prosecutors say committed the heinous crime, sent shockwaves through the state. When Somerville District Court Judge Paul P. Hefferman ruled that the Commonwealth try Mr. O'Brien as a juvenile, those shockwaves grew in intensity, and the citizens of Massachusetts, fed up with increasing youth violence and perceptions of an ineffective juvenile justice system, demanded the enactment of tough new laws to deal with repeat and violent juvenile offenders. The Great and General Court of Massachusetts headed these demands for reform of the juvenile justice system and enacted legislation that, among other things, abolishes the trial de novo system in the juvenile courts, requires the trial of juveniles charged with murder, manslaughter, aggravated rape, forcible rape of a child, kidnaping, assault with intent to rob or murder and armed burglary in adult court and permits prosecutors to open to the public juvenile proceedings when they seek an adult sentence. Although proponents tout these measures as a sagacious solution for the vexatious problem of juvenile delinquency, abolishing the trial de novo system, providing for automatic adult trials and opening juvenile proceedings to the public when prosecutors seek an adult sentence works to the detriment, not the benefit, of juveniles and society. Therefore, the policy makers of Massachusetts should repeal most sections of the Juvenile Justice Reform Act and develop other policies to deal with the rising problem of juvenile crime. I. A SINGLE TRIAL SYSTEM PREVENTS COURTS FROM PROVIDING RAPID ASSISTANCE TO JUVENILES IN NEED, DOES LITTLE TO SERVE JUDICIAL ECONOMY AND PLACES A SIMILAR BURDEN AS THE DE NOVO SYSTEM ON VICTIMS AND WITNESSES.   Ã‚  Ã‚  Ã‚  Ã‚  Proponents of a single trial system for juveniles argue that the trial de novo system wastes judicial resources by giving defendants a second bite at the apple and traumatizes victims and witnesses by forcing them to testify at two proceedings. However, these proponents fail to acknowledge that the de novo system allows judges to quickly provide juveniles with the rehabilitative help they need. The proponents, unsurprisingly, also fail to acknowledge that a single trial system may place a greater burden on judicial resources and a similar burden on victims and witnesses.   Ã‚  Ã‚  Ã‚  Ã‚  The de novo system benefits juveniles by encouraging bench trials, which frequently result in the swift administration of rehabilitative

Analyses of the Extent to Which the Reliability

In Ken Kesey’s One Flew Over the Cuckoo’s Nest, a patient suffering from schizophrenia was chosen to narrate the story, which greatly affects our perception of the events in the novel. The world that Kesey creates in the novel is through the eyes of Chief Bromden, a chronic patient in the ward. Bromden’s observant nature causes for very detailed descriptions of the events in the novel. Chief fakes being deaf, and as a result, he is able to eavesdrop any conversation in the ward, often being able to reveal foreshadowing details, and otherwise secret information.Although these characteristics make him a reliable source and a good narrator, Chief’s schizophrenic episodes and paranoid nature create skewed views of reality, with very little distinction as to what is a literary device, or what is literally a hallucination. If the narration were given through a more rational character, such as McMurphy, the differentiation between delusion and actuality would hav e been more cogent. Using Chief Bromden as a narrator restricts the reader’s perception of the novel, despite this, a very reliable and creative perspective of the events is then created, which gives a huge edge to the novel.The very detailed accounts of the events make each scene seem more real. As the very descriptive narrator that Bromden is, the world that he describes is very unique. Chief uses the metaphor that the world is a â€Å"combine† in that it takes the undesirable or less than perfect members of society, mangles, chops, and slashes them into the proper shape and size for acceptability, and then spits them right back out. In the words of Bromden, â€Å"The ward is a factory for the Combine. It's for fixing up mistakes made in the neighborhoods and in the schools and in the churches, the hospital is.When a completed product goes back out into society, all fixed up good as new, better than new sometimes, it brings joy to the Big Nurse's heart. † Itâ €™s these kinds of comparisons made by Bromden that are exclusively his own, and explain the types of views held by the beats generation, such as their views on the dangers of conformity. Despite the extensive detail used in Bromden’s descriptions, such as the striking detail used in describing Nurse Ratched’s log book â€Å"They spy on each other.Sometimes one man says something about himself that he didn't aim to slip, and one of his buddies†¦ sidles over to the big log book by the Nurses' Station and writes down the piece of information he heard of- of therapeutic interest to the whole ward, is what the Big Nurse says the book is for†¦ † But on the other side of the spectrum, Bromden’s schizophrenia adds a sort of shroud to the perception that people get from his narrations. So she really lets herself go and her painted smile twists, stretches to an open snarl, and she blows up bigger and bigger, big as a tractor, so big I can smell the m achinery inside the way you smell a motor pulling too big a load† in any other novel, this sort of observation would be passed off simply as literary devices, but Chief Bromden actually perceives Nurse Ratched as getting bigger as a result of the anger caused by conduct not being followed in her ward.These hallucinations that occur regularly in the novel have a huge affect on the reader’s perception of events in the novel, because the reader can experience through the eyes of a person who is actually mentally ill, which makes the novel and the events within it all the more relevant to those reading it. Utilizing the facade that he was deaf, Bromden would consistently listen in on Nurse Ratched and other members and staff in the ward, and his nonchalant way of doing it made him a very indispensible, integral character to the plot.Most of the foreshadowing events that Chief conveys to the reader was overheard from people in the ward. Believeing he was deaf, Nurse Ratched would constantly, unknowingly, disclose confidential information to Chief when he would over hear her discussing this information. For example, Chief Bromden overheard the doctors discussing amongst themselves how to best deal with McMurphy and the disruptive behavior that he brought to the ward.The doctors were arguing over weather or not to send him to the Disturbed branch of the hospital. As the doctors debated amongst themselves, Nurse Ratched eventually intervened, â€Å"He is simply a man and no more, and is subject to all fears and all the cowardice and all the timidity that any other man is subject to. Given a few more days, I have a strong feeling that he will prove this, to us as well as the rest of the patients.If we keep him on the ward I am certain his brashness will subside, his self-made rebellion will dwindle to nothing, and our redheaded hero will cut himself down to something patients will all recognize and lose respect for† this suggestion made by Mildred f oreshadows her intentions for McMurphy, and is a very good example of how Bromden’s faking of being â€Å"Deaf & Dumb† adds to his ability and reliability of being able to deliver good perception of the novel to the reader.Ken Kesey’s choice to use Bromden as a narrator has many positives and negatives. Bromden is able to act as a very effective channeler of information to the reader, as he is able to secretly eavesdrop on confidential conversations that give light to the shady events that take place in the ward. Bromden’s ability to describe and explain events in the novel in such extraordinary detail help the reader better understand the plot and complexities in the story.Despite all of this, Bromden’s aggressive mental illness creates many defects in the delivery of understanding and sense to the reader. The atmosphere of the ward can often be obstructed by the â€Å"fog† that Bromden’s paranoia constantly drags him into, and these brief escapes from reality, although very engaging and intimate, can hinder the reader’s ability to comprehend the content of the novel.Kesey’s use of hallucinations also put up another wall in the perception of the reader, because the differentiation between veracity and phantasm is very hard to make. Overall, Bromden’s position as narrator is very successful in delivering the main points and fundamental values of the Beat inspired Kesey, such as the importance of individualism, the dangers of blind conformity, and the natural human quality of spontaneity.

Message of the story Essay The opening of the novel is a letter from Walton to his sister. He writes about his dream expedition to discover a passage near the pole to those countries to reach which at present so many months are requisite. He wants to be the first to step foot open ground no other man has stepped on, and discover the wondrous power which attracts the needle. Walton says I preferred glory to every enticement that wealth placed in my path this shows Walton is a hungrier for fame and admiration rather than money. He voluntarily endured cold, famine, thirst, and want of sleep this makes the reader think he is over obsessed. This is parallel to Frankensteins obsession to recreate life. Waltons character is similar to Frankensteins; they are both over ambitious, knowledgeable and unaware of the dangers in consequence to their actions. The point Shelley is trying to make throughout the story is that these qualities in a person, if out of control, could cause problems. Frankenstein is obsessed with science, natural philosophy, and particularly chemistry became my sole occupation. Shelley writes that during the creation of the creature Frankenstein is spending days and nights in vaults and charnel-houses. At this point he comes across as quite crazy and rather disturbing. He appears to be so excited and passionate to the extent that he doesnt even realise what he is doing is disgusting and immoral. I pursued my undertaking with unremitting ardour. My cheek had grown pale with study This shows us that, similar to Walton, he stays up for endless hours, doesnt go home or even eat. Frankenstein does not realise he is making mistakes, this is shown when he says: Sometimes, on the very brink of certainty, I failed; yet still clung to the hope However us as the readers know the future doesnt look so bright for Victor, he may be hopeful, but he is not thinking before carrying out his investigations. Shelley is sending the message that science is risky and dangerous, it was poorly understood therefore scientists were making thoughtless decisions. Shelley writes the creature coming alive from Frankensteins point of view therefore it is very biased. Even though the creature is described in great detail, it is only described by its looks. Frankenstein becomes prejudice and claims the creature is a wretch grotesque and vile. Its features include straight black lips and yellow skin scarcely covering the work of muscle and arteries. This gives us the impression that the creature is some kind of deformed monster. This is the point that Frankenstein finally faces reality and comes to know of his mistakes. However, he still makes another mistake he doesnt accept the responsibility for his actions and runs away. This is shown when he says the beauty of the dream vanished, and breathless horror and disgust filled my heart. Further in the chapter Frankenstein awakes from his nightmare to find the creature by his side with jaws open a grin wrinkled on his cheek and one arm stretched out, seemingly to detain. This gives us the impression that this hideous creature is violent and threatening to mankind. At this part in the story it appears the creature has no feelings or emotions. In this scene the rain pattered dismally this reflects the mood, the disappointment and bitterness Victor Frankenstein is feeling. We feel even more sympathy for the creature when on his travels he enters a village to be welcomed by shrieking children, and attacks to end up bruised by stones and many other missile weapons. The creature has now learnt to expect bad reactions knowing that humans are prejudice after just experiencing the barbarity of man. He starts to experience fear so seeks asylum, but is not at all aggressive. Shelley illustrates the creature to be appreciative and observant. This is shown when he saw the young girl taking up the instrument and playing to produce sounds sweeter than the voice of the thrush or the nightingale. This shows he is empathetic and sees innocence in everything inconsiderate of how others have treated him. Shelley wants us to feel sorry for the creature because he wouldnt be living under such horrible circumstances if people would take responsibility for their actions.

The company has received several complaints concerning the amount charged for services which was found to be incorrect by customers (Vodafail.com, 2011). These problems were blamed on unreliable Vodafone’s billing system; this system has had outages from December 2010 to January 2011. After reporting the problem, the person concerned checked the bills and confirmed the mistakes and customers were refunded. However, the source of the problem was not investigated; therefore, it was not solved. This means that there is a possibility of the problem recurring and every now and then, and if the trend continues some customers will get tired and shift to a more service efficient company. Sometimes customers experience dropping of calls and are charged a flag fall and every time they retrieve their calls they charged a minimum charge for it (Vodafail.com, 2011). This has resulted in high monthly bills and after monitoring the bandwidth it was realized that there was a higher usage than that of Huawei software. This issue required that the billing services be investigated to ensure that the billing was done fairly, however, according to some customer s Vodafone staff suggested to them to shift to a plan that was more expensive, and did not inform them about the new 24-month contracts (Vodafail.com, 2011). There are other customers who signed up for three months free service, but according to others, the three months were not free because they were counted the fourth, fifth and sixth contract. This experience was not appealing to customers, and if such complaints are not well taken care of customers would not hesitate to move away from the company. There are some cases where customers experience reception and are unable to make calls; this issue distress customers because they cannot make urgent and emergence calls and some cannot contact their families. Those who use such a service for doing business have to deal with the financial impacts associated with the technical problem (Vodafail.com, 2011). When customers try to conduct the customer care using the given number they congest lines making it difficult for some of them to re port their problem to the company. Some Vodafone employees have not been able to solve reported problems with others denying the existence of network issues while others dismissed the problems as handset related; employees in the customer care department should report any problem that is beyond their capacity (Vodafail.com, 2011). All this problems recurring and experienced by several customers show that Vodafone does not attend to customers complaints with the urgency, efficiency and effectiveness they deserve, and yet the problems can be easily solved through better communication between customers and company’s staff (Vodafail.com, 2011). If the company realizes any technical problem that might disrupt their service to their customers, the first thing is to inform customers earlier through their handsets, they should handle the problem within the shortest time possible assuming that customers depend on their service alone. After the problem has been solved entirely, they sh ould inform customers about returned normalcy as they try to monitor the systems. Vodafone staffs seemed unaware of the steps to follow to solve a problem in a service system; therefore, each one feels not responsible for problems in the service system and again no one feels responsible for solving the problems (Vodafail.com, 2011). The two companies should understand that effective service delivery requires constant interaction with customers; this will help them to understand the experiences of customers and their expectations, as well as their level of satisfaction. After collecting information about customers’ experiences and expectations, these companies should be able to adjust the way they deliver their services, and services they offer to their customers so as to meet their expectations (Vodafail.com, 2011). The companies should also understand that their customers cannot be satisfied all the time; therefore, they should expect complaints from time to time, and, in fa ct, these companies should treasure complaints because they give them a chance to improve on services they offer and how they offer them (Singtel, 2005). Complaints also help them assess how efficient they are in offering their services, compared to other companies offering the same services. The companies, therefore, should include feedback to customers in their service delivery systems any time they are handling a complaint. This is to ensure that the problem has been solved fully, and the customer is satisfied. Fig, 2. The recommended blueprint After the customer has reported a problem with the service he or she is receiving, the customer care should review the case to see if he or she have a capacity to solve the problem or offer assistance to the customer, if there is any technicality involved that is beyond his or her ability then the case should be forwarded to the team leader for solving problems or the TIO (Optus, 2008). As this team work hard to solve the problem, they sh ould maintain a feedback loop to ensure that the problem is solved effectively. Additionally, the customer should not be left in the dark regarding the problem because he or she feels the effect the most, constant feedback should be given to the customer to assure him or her that the problem is being taken care of, and the service will return to normalcy soon. The companies should also realize that it is not only the customer to report anomalies in their service delivery, but also the technical team. Therefore, in case of a technical problem or a forecasted problem, the company should take an initiative of informing the customer before he or she notices any problem, this would help the customer plan for an alternative or use the service before it is disrupted (Hoffman, 2010). This will reduce the inconveniences caused by the company and maintain customer relations. The customer should be informed of any interruptions of service prior to the actual interruption.
